A BILL
FOR A LAW


TO AMEND THE STATE JUDICIAL SERVICE COMMISSION LAW No. 1 OF 2002 FOR THE PURPOSE OF BRINGING ITS PROVISIONS RELATING TO MEMBERSHIP AND APPOINTMENT OF SECRETARY IN LINE WITH SECTIONS 5 AND 6C OF PART IIc OF SCHEDULE 3 OF THE CONSTITUTION OF THE FEDERAL REPUBLIC OF NIGERIA 1999

 

BE IT ENACTED by the Delta State House of Assembly as follows:

CITATION AND DATE OF

COMMENCEMENT

1. This Law may be cited as the State Judicial Service Commission (Amendment) Law of Delta State 2003 and COMMENCEMENT shall come into force on the day of 2003.

2(1) The State Judicial Service Commission Law No. 1 of 2002 (hereinafter referred to as "the Principal Law") is hereby
amended as set out in this Law.

 

AMENDMENT OF
SECTION 3 OF THE
PRINCIPAL LAW

(2) Section 3 of the Principal Law is amended:-
(a) in subsection (1)(d) thereof by deleting the phrase "who shall be nominated by the five branches of the Nigerian
Bar Association in Delta State."

(b) by substituting for the existing subsection (2) thereof the following new subsection, that is-

"(2) There shall be a Secretary to be appointed by the Commission who in addition to his functions as secretary, shall have such other functions of an administrative nature as may from time to time be assigned to him by the Commission or the Chairman"

(c) by inserting a new subsection (3) as follows-

"(3) A person shall not be qualified to hold the office of Secretary of the Commission unless he is qualified to practice as a legal practitioner in Nigeria and is so qualified for a period of not less than ten years.
